Article 1: Orders

1.1 Placing an order: A firm order is placed when the customer clicks the "Confirm my order" button just before the payment page. By placing your order, you submit a request to purchase the products you have selected and placed in your cart. We reserve the right to accept or refuse this offer at our discretion.

1.2 Order confirmation: Condomplanet Sàrl confirms the acceptance of the order and its progress to the customer at the email address provided during registration. This confirmation is effective when the customer receives an email from Joujou.ch indicating that the order has been placed: "Order confirmation" or "In delivery". This email forms a sales contract between you and Condomplanet Sàrl.

1.3 Order cancellation: Condomplanet Sàrl reserves the right to cancel any order from a customer with whom there is a dispute regarding payment of a previous order.

1.4 Error in recipient details: In the event of an error in the recipient's details, Condomplanet Sàrl cannot be held responsible for a delivery error or the inability to deliver the ordered product(s).

1.5 Shipping costs: Orders with a value below CHF 40.00 are subject to a surcharge of CHF 5.90 for administrative costs.

1.6 Age requirement: By placing an order, you certify that you are 18 years of age or older.

1.7 Retention of title: Delivered products remain the property of Condomplanet Sàrl until full payment is received.

Article 2: Prices

2.1 Price on order confirmation: The price invoiced to the customer corresponds to the price indicated on the order confirmation, which displays any applicable fees and discounts. The prices on the order confirmation are binding, even in the event of price changes between the order date and the delivery date.

2.2 Price error: In the event of a pricing error on a product, Condomplanet Sàrl reserves the right to modify it. In this case, Condomplanet Sàrl will offer the customer the option to cancel their order if the new price is not acceptable.

2.3 Taxes and customs duties: Swiss VAT is included in our prices. For shipments abroad, our deliveries are based on prices in Swiss francs excluding taxes, upon request. For international deliveries, we do not charge VAT, but the customer will need to pay the VAT of their country as well as any customs duties.

Article 3: Payments

We accept the following payment methods:

  • 3-D Secure credit cards
  • PostFinance - PostCard and E-Finance
  • Invoice payment with CembraPay SA
  • Payment with PayPal
  • Payment with TWINT
  • Bank transfer (Advance payment)

Article 4: Delivery

4.1 Deliveries in Switzerland and Liechtenstein: For orders delivered in Switzerland and Liechtenstein, shipping is free for orders of CHF 50.- or more. Otherwise, a small order fee of CHF 6.90 applies.

The customer can choose between PostPack Priority or Swiss Express delivery with or without signature. Once the order is shipped, the customer receives a tracking number. Condomplanet Sàrl assumes no responsibility in case of loss or theft of a shipment.

4.2 Deliveries to other countries: Our products are shipped via UPS Express, with an estimated delivery time of 2 to 3 business days from the shipping date. Orders for destinations outside Switzerland must have a minimum value of CHF 170.00.

For shipping and packaging costs, please note the following rates:

For countries such as Germany, Andorra, Austria, Belgium, Bulgaria, Denmark, Spain, Finland, metropolitan France, Ireland, Italy, Luxembourg, Monaco, the Netherlands, Portugal, Sweden, the fee is CHF 39.90.

All orders shipped outside Switzerland are tax-exempt. However, upon customs clearance, the applicable VAT in the destination country will be calculated and charged to you, in addition to any customs duties.

4.3 Delivery times: For products in stock, Condomplanet Sàrl offers delivery within 24 to 48 hours. If the product is not in stock at the time of order, the delivery time will be determined by availability from distributors/manufacturers. In case of out-of-stock items, the delay is generally 3 to 7 days. We indicate the availability and/or estimated delivery time for each product. This information is indicative and not guaranteed. The customer can request a delivery time estimate by email at any time.

Condomplanet Sàrl cannot be held responsible for any delivery delay resulting from an error or delay by the delivery service provider (Swiss Post). Such a delay does not entitle the customer to any compensation or refund and does not allow for free cancellation of an order.

Article 5: Right of Return

5.1 Withdrawal period: Condomplanet Sàrl grants its customers a withdrawal period of 14 calendar days from the delivery of the products. During this period, the customer may return the products, provided they are neither damaged nor opened and are still in their original packaging (control labels intact).

5.2 Return costs: For any merchandise return or order cancellation, administrative fees of CHF 20.- apply. Shipping and return costs are borne by the customer.

5.3 Exceptions to the right of withdrawal: The right of withdrawal does not apply to cosmetic products such as lubricants, creams, cleaners, etc., as well as lingerie items and silicone dolls.

Due to customs complexities and transport costs, the right of withdrawal does not apply to deliveries outside Switzerland. Orders with international delivery are considered final and cannot be cancelled. For international deliveries, Condomplanet SàRL (Joujou.ch) provides the customer with order tracking but declines any responsibility in case of non-delivery. It is the customer's responsibility to inform themselves of any import restrictions, tax requirements, and customs regulations of the destination country.

5.4 Warranty: Electrical or electronic products on JouJou.ch are covered by a 2-year manufacturer's warranty from the delivery date. Other products are not covered by a warranty. In case of repair or exchange of a defective product, the warranty will not be extended or renewed.

5.5 Return request: For any return related to a delivery error, defective product, etc., a return request is mandatory. All return requests must be made through our contact form.

5.6 Defective products under warranty: Defective products covered by warranty will be systematically replaced with a new, identical product, unless the product is no longer available. In that case, a credit note or replacement item will be offered to the customer.

5.7 Return costs: Return costs are, in all cases, borne by the customer.

Article 6: Liability

6.1 Limitation of liability: These Terms and Conditions determine all of our obligations and responsibilities. We are not bound by any other warranty, condition, or provision, except those expressly mentioned in this contract.

Any warranty, obligation, or other provision concerning products or services, whether by law, jurisprudence, or otherwise, is expressly excluded. In particular, Condomplanet Sàrl does not guarantee that the products are suitable for your intended use.

6.2 Exclusion of indirect or consequential damages: Our liability cannot be engaged for any loss of revenue, loss of profits, loss of contracts, loss of data, or for any indirect or consequential damage of any kind. Our total liability cannot under any circumstances exceed the amount due for the products or services concerned.

6.3 Circumstances beyond our control: We cannot be held responsible for losses or damages resulting from delays in the performance of our obligations if such delay is due to circumstances beyond our control.

6.4 Product liability limitation: Condomplanet Sàrl declines all responsibility for material, immaterial, or personal damages resulting from malfunction or misuse of marketed products. Condomplanet Sàrl's liability is limited to the order amount.

Article 7: Buyer's Acceptance

7.1 Acceptance of terms and conditions: These terms and conditions and the prices are expressly approved and accepted by the buyer. Order confirmation constitutes acceptance of these terms and conditions.

7.2 Age certification: The buyer also certifies being at least 18 years of age. These terms and conditions are exclusively intended for adults.

7.3 Modifications to terms and conditions: These terms and conditions may be modified at any time without notice. It is the buyer's responsibility to regularly consult the updated terms and conditions on joujou.ch.

7.4 Disputes: This contract is governed by Swiss law. In case of dispute, Condomplanet Sàrl reserves the choice of the competent court.

7.5 Other cases: For all other cases not governed by these terms of sale, the Swiss Code of Obligations applies.
